His battery which was located East of St. Vith, was attacked by German infantry on December 17, 1944 and surrounded within a short time. The men who were not surrounded were given orders to mount trucks and proceed West to St. Vith. It was presumed that Pvt Bailey was either captured or killed. Captured German records contain no reference to Pvt Bailey. There is no burial report for him.
In July-August 1951 an investigation was conducted in the vicinity of Herresbach, Amel and Schönberg, Sankt-Vith to recover his remains, with negative result. Therefore it was concluded that Pvt Bailey went Missing in Action on 17 December 1944 and, according to official procedures, he was declared death at the official date of 18 December 1945.
